Parliament supports extension of deadlines for covert investigations

The deadlines for conducting covert investigative actions are extended, and the circle of crimes which allow for covert investigative actions is increasing. At the same time, the rule of notifying the relevant person of the information about the conduct of a covert investigation is changed.

 

According to the legislative changes, if the covert investigative action is carried out under 108th, 109th, 142nd, 142/1, 143rd-143/2, 144th - 144/3, 155th, 157 / 1, 194th, 194/1, 223rd - 226th, 230th - 232nd, 234th - 235/1, 239/1, 252nd, 255th Article Sections 3 and 7, 255/1, 260 Article Sections 4 and 7, 261 Article Sections 4 and 8, 262th, 263th, 284th, 308-321/1, 3221 - 333rd, 337th - 339th, 341st, 342nd, 343rd, 343/1, 345th, 346th, 404th - 413th articles of Criminal code, the notification of the information on the conduct of the covert investigation to the person against whom it was made may be delayed as many times as necessary to avoid endangering public safety, public order and the effective functioning of the investigative body.

 

In this case, the notification of the information to the relevant person about the conduct of a covert investigative action, under the control of the court, may be postponed each time for a period of not more than 12 months.

 

The draft amendments to the Criminal Procedure Code were supported by the Parliament in the first reading. The bill was passed by 77 votes to 8.

 

The initiators of the project are MPs: Irakli Beraia, Alexander Tabatadze, Vladimer Chachibaia, Resan Kontselidze, Gia Benashvili, Irakli Chikovani, Eka Sepashvili, Rati Ionatamishvili, Giorgi Khelashvili and Kakha Kakhishvili.
