Salome Zourabichvili: Lack of communication on such issues concerning human rights and citizens' relations with law enforcement agencies is detrimental to everyone because it raises distrust

According to her, more communication was needed around the bill.

 

"The issue of amendments to the Code of Administrative Offenses has become a matter of public concern these days.

 

Accordingly, first of all, I met with representatives of the parliamentary opposition and the initiators of the bill from the ruling party. I heard the arguments of all parties before making the decision.

 

I agree with the opposition's arguments that the adoption of such a law at the very first session in which the opposition participated did not comply with the spirit of the newly reached agreement. I also share the opinion that once the representatives of the opposition enter the parliament, they should be given the opportunity to participate fully in the legislative work. This process required more communication, including with the public, so that changes in the law could be fully understood and shared by our citizens.

 

Lack of communication on such issues concerning human rights and citizens' relations with law enforcement agencies is detrimental to everyone because it raises distrust. Such a sensitive issue requires everyone to be involved in discussion. Thus the chosen procedure for making changes in an expedited manner did not give everyone equal opportunities to present their arguments.

 

I also share the fact that when the public is waiting for the initiation of three main laws under the April 19 agreement – the amnesty law, electoral code and judicial reform – the accelerated adoption of this law may be considered politically untimely.

 

Thus, for political expediency, I would not rule out the use of a veto. On the other hand, the use of veto must be based on well-established legal arguments. In this respect, the new amendments do not contradict our Constitution, nor can they be considered a violation of any legal principle or a disregard for any international standard. Thus, in this particular case, the legal basis for veto was insufficient. However, in the future, similar process may allow the President to use this tool effectively if needed.

 

Finally, as the President of the country, I should stress that the law enforcement agencies represent a state institution on which the order and stability of any democratic country stands. Elementary respect for them is a necessary civic duty, however, this can be achieved not only through sanctions and fines, but also through civic awareness," the President said.
