Ombudsman on changes in the law "On Assemblies and Manifestations": There is intense interference in the freedom of expression and assembly

The Public Defender responds the planned amendments to the Georgian law "On Assemblies and Manifestations" in the Parliament of Georgia and believes that the presented project is an intense interference in the freedom of expression and assembly, which limits the expression of opinion by using temporary constructions, for example, a tent.

 

The Ombudsman believes that such "intense restriction of freedom of expression in a democratic society can be justified only by the need to protect an important, interest", which is not covered by the presented draft law.

 

"With the changes, the assembly and demonstration participants will be prohibited from setting up temporary constructions on 5 possible grounds, which, according to the Public Defender, are not sufficient to establish the restrictions presented by the project.

 

According to the Public Defender, the current norms already provide for the possibility of relevant response in case of such threats, and there is no need to impose additional prohibitions in this regard. Moreover, the draft law allows for a wide interpretation," it is noted in the statement released by the Office of the Public Defender.
