Parliament passes draft amendments to Organic Law on Common Courts prepared within the framework of EU 12-point recommendations

The Parliament approved the draft amendments to the Organic Law on Common Courts, which was prepared within the framework of the 12-point recommendations of the European Union.The draft law was adopted in the third reading with 83 votes (against one).

 

The draft Law on Common Courts organically provides for the following issues: The procedure for releasing the judicial act adopted as a result of an open court session to any interested person as public information is established.

 

The following limitation is established regarding the appeal of the decision of the Supreme Council of Justice adopted in the process of selecting candidates for the position of a judge of the Supreme Court and the submission of the Council: If, as a result of the review of the appeal, the Qualification Chamber of the Supreme Court found that a member of the Supreme Council of Justice was biased in the process of selecting candidates, his/her approach is discriminatory was or s/he exceeded the authority granted to him/her by the legislation, as a result of which the candidate's rights were violated or the independence of the court was threatened, this member of the Supreme Council of Justice no longer participates in the process of receiving a re-order/re-submission by the Council.

 

The procedure for appointing a person to the vacant position of a district or appellate court judge is changed. In particular, it is established that the Supreme Council of Justice shall appoint a judge to the vacant position of a judge of the district or appellate court in the manner established by the rule of selection of a candidate to be submitted to the Parliament for election to the position of a judge of the Supreme Court.

 

A candidate for the membership of the Council participating in the procedure for electing a judge member of the Supreme Council of Justice will be entitled to address the conference of judges before the vote and present his/her vision and opinion on the issues related to the exercise of his/her powers as a member of the Supreme Council of Justice in case of his/her election as a member of the Supreme Council of Justice.
